Expert Witness Services For Commercial Properties

Expert witnesses are often required to provide an independent opinion on technical matters.  Dabinett have acted as expert witnesses many times, providing independent advice to aid and inform parties and their legal counsel.

Dabinett’s involvement may be from early on, prior to matters progressing towards court.  In these circumstances reports are often provided to set out the basis of claims from a technical perspective, acting as a joint expert or an expert acting for just one party.

When matters do proceed to court then expert witness reports are completed in accordance with the Civil Procedure Rules (CPR).  Section 35 of the CPR sets out the role of the expert witness.   In addition the Royal Institution of Chartered Surveyors have mandatory practice note on the role of the surveyor in acting as an expert witness.
